Elon Musk’s artificial intelligence venture, xAI, has initiated legal action, alleging that Terry Harwood circumvented Grok’s integrated safeguards to generate child sexual abuse material (CSAM). The company is pursuing claims for both reputational harm and financial damages.

The lawsuit, which was first reported by Reuters, names a South Carolina resident, Terry Wayne Harwood, as the defendant. xAI asserts that Harwood “knowingly and intentionally used Grok to circumvent safeguards, alter nonconsensual images, and generate and distribute CSAM,” in direct violation of the company's established policies.

Harwood’s alleged activities align with his arrest in February on charges of possessing and distributing CSAM, for which he currently faces eight felony counts. The legal filing contends that “at least some” of the images central to Harwood’s criminal charges were either “generated or altered” using Grok. Furthermore, xAI claims Harwood deliberately bypassed Grok’s security protocols and “abused the tool to convert non-sexual photographs into sexually explicit images” without obtaining the subjects’ consent.

This legal challenge emerges against a backdrop of prior controversies surrounding Grok. Following the introduction of a “spicy” mode and an image editing feature last year, the chatbot was linked to a proliferation of sexualized AI deepfakes, including those depicting minors. In March, a group of teenagers filed a lawsuit against xAI, alleging Grok created sexualized images of them as minors. While Elon Musk previously stated that, “Anyone using Grok to make illegal content will suffer the same consequences as if they upload illegal content,” this current lawsuit marks the first instance of xAI suing an individual over AI deepfakes generated via Grok.

xAI argues that Harwood’s alleged actions have exposed the company to “significant legal risk and reputational damage.” Consequently, the company is petitioning the court to compel Harwood to compensate xAI for any incurred damages and to cover “reasonable expenses incurred defending itself in any legal action filed by a victim of Defendant’s conduct.” Additionally, xAI seeks a court order to prohibit Harwood from creating any future xAI accounts or utilizing Grok.
