The state of Mississippi classifies these power plants as "mobile" because they are mounted on flatbed trailers, thereby allowing them to bypass air pollution regulations for a period of one year. The NAACP, which has initiated legal action on behalf of local residents, contends that the unregulated emissions from these turbines are exacerbating air quality issues in an already compromised region. This week, the organization formally requested an injunction against xAI from the court.
Central to the legal challenge is the state's designation of the turbines as "mobile." The Southern Environmental Law Center (SELC), representing the NAACP in the lawsuit, argues that the operation of these turbines violates federal law. Federal statutes stipulate that power plants, even when mounted on trailers, can still be considered stationary and are thus subject to air pollution regulations.
While xAI has secured permits for 15 of its turbines, earlier communications from the Greater Memphis Chamber of Commerce had indicated that "about half" of 35 turbines projected to be operational by May 2025 would remain on-site. However, xAI has proceeded with further installations. A recent local news report confirms that the company is presently operating 46 turbines.
