Ann Altman’s lawsuit against her brother has been dismissed with prejudice, rendering it unable to be refiled.
On Tuesday, US District Judge Zachary Bluestone dismissed the lawsuit filed by Ann Altman last year, which alleged that her brother, OpenAI CEO Sam Altman, sexually abused her during her childhood. As reported by The Guardian, the judge ruled that Ann failed to appear for an independent medical examination or meet critical deadlines despite prior warnings that such inaction would lead to dismissal.
Upon the case's filing last year, a statement from Sam Altman, his mother, and his brothers asserted, “Annie has made deeply hurtful and entirely untrue claims about our family, and especially Sam… All of these claims are utterly untrue. This situation causes immense pain to our entire family.”
Judge Bluestone granted Sam Altman’s motion to dismiss the case with prejudice, preventing a refiling in that jurisdiction, and denied his request for attorney fees and costs. Santos Perez, Ann’s lawyer who withdrew this month, told The Guardian, “I am no longer authorized to comment on this case but I continue to believe in Annie.”
