On Tuesday, President Donald Trump enacted an executive order establishing a mechanism for the government to review advanced artificial intelligence models prior to their public release.

This directive requests that specific AI firms voluntarily provide their novel models to the government for testing or assessment a month before making these products available to the public. An earlier iteration of the order had proposed a voluntary review period of up to 90 days, though prominent figures within the AI industry advocated for a much shorter timeframe, closer to two weeks.

President Trump was initially scheduled to sign the more stringent version of this order in late May; however, it was postponed following significant industry resistance, notably from venture capitalist and former White House AI czar David Sacks. The President stated then that his aim was to avoid impeding American AI companies in their competitive standing against China.

The order, formally published on Tuesday, explicitly states: “Nothing in this section shall be construed to authorize the creation of a mandatory governmental licensing, preclearance, or permitting requirement for the development, publication, release, or distribution of new AI models, including frontier models.”

Initially, President Trump had intended to sign the executive order in the presence of numerous leading Silicon Valley CEOs, but ultimately signed the finalized version privately.

Beyond the voluntary review of AI models by the government, the executive order also instructs the Department of Justice to prioritize enforcement against offenses such as AI-assisted hacking and unauthorized digital access.

This recent executive order marks not the President’s inaugural foray into AI regulation. Last December, Trump had previously signed an order tasking the creation of a “one rulebook,” a comprehensive national AI policy framework designed to supersede individual state AI legislation.
