New York state lawmakers have introduced a legislative proposal that seeks to impose a moratorium of at least three years on permits for the construction and operation of new data centers. While the future of this bill remains uncertain, reports from Wired indicate that New York is now at least the sixth state actively considering a pause on new data center development.

As technology giants allocate increasingly substantial investments toward building artificial intelligence infrastructure, concerns are mounting across the political spectrum regarding the potential impact of these data centers on local communities. Both Democratic and Republican officials have voiced apprehension, and studies have additionally drawn a correlation between data centers and elevated residential electricity bills.

Among the prominent critics is progressive Senator Bernie Sanders, who has advocated for a national moratorium on data centers. This sentiment is echoed, albeit with different reasoning, by conservative Florida Governor Ron DeSantis, who asserted that data centers would lead to “higher energy bills just so some chatbot can corrupt some 13 year old kid online.”

Adding to the chorus of opposition, a coalition of over 230 environmental organizations, including influential groups like Food & Water Watch, Friends of the Earth, and Greenpeace, recently issued an open letter to Congress, collectively calling for a nationwide halt to the construction of new data centers.

Eric Weltman of Food & Water Watch revealed to Wired that the New York bill, championed by Democratic state senator Liz Krueger and assemblymember Anna Kelles, originated from his organization’s initiative. The movement for data center pauses is gaining traction across the country, with similar proposals advanced by Democrats in Georgia, Vermont, and Virginia, and by Republicans in Maryland and Oklahoma.

Senator Krueger, according to Politico, characterized her state as “completely unprepared” for the influx of “massive data centers” that are currently “gunning for New York.”

“It’s time to hit the pause button, give ourselves some breathing room to adopt strong policies on data centers, and avoid getting caught in a bubble that will burst and leave New York utility customers footing a huge bill,” she articulated, emphasizing the urgency of the proposed moratorium.

In a related development last month, New York Governor Kathy Hochul unveiled a new program titled Energize NY Development. Her administration stated that this initiative aims to both modernize the grid connection process for large energy consumers, such as data centers, and ensure that these entities are required to “pay their fair share” for their energy usage.
