New York lawmakers are poised to debate two significant pieces of legislation: one mandating disclosure for AI-produced news content and another proposing a three-year halt on new data center development.

The proposed New York Fundamental Artificial Intelligence Requirements in News Act, or NY FAIR News Act, aims to ensure transparency in media. It stipulates that any news material "substantially composed, authored, or created through the use of generative artificial intelligence" must include a clear disclaimer. Furthermore, the bill mandates that all AI-generated content undergo human review and approval by an individual with "editorial control" prior to publication.

This legislation also extends its reach to internal newsroom operations, requiring organizations to inform their employees about the specific applications and timing of AI usage. Crucially, it calls for the implementation of robust safeguards to protect confidential information, particularly details concerning sources, from being accessed by artificial intelligence systems.

Concurrently, Senate Bill S9144 proposes a minimum three-year "moratorium on the issuance of permits for new data centers." The bill's rationale stems from escalating electric and gas rates impacting residential, commercial, and industrial consumers. National Grid New York has reported a threefold increase in requests for "large load" connections within the past year alone, projecting an additional demand of at least 10 gigawatts over the next five years. Data Center Map indicates that New York currently hosts over 130 data centers.

This proposed pause comes as the state recently sanctioned a 9-percent rate increase for Con Edison customers over the upcoming three years, reflecting a broader national trend of soaring electric bills and increased strain on power grids, significantly exacerbated by the growing demands of data centers.
