In the high-profile legal battle known as Musk v. Altman, Elon Musk has taken the stand as the inaugural witness.

Mr. Musk formally commenced his testimony in the lawsuit he initiated against OpenAI CEO Sam Altman and the company's President, Greg Brockman.

The trio were foundational members of OpenAI's initial team, with Musk contributing up to $38 million in early investments. However, the relationship between the co-founders deteriorated due to fundamental disagreements regarding the company's structure and mission, notably a proposal to integrate OpenAI into Musk's Tesla enterprise. Following his departure, Musk later established xAI, a direct competitor to OpenAI, which is currently under the ownership of Musk’s SpaceX.

While Mr. Musk has initiated at least four lawsuits against OpenAI in recent years, many of which were subsequently withdrawn or dismissed, the current litigation stands out. This particular suit designates Altman, Brockman, Microsoft, and OpenAI itself as defendants, and has successfully advanced to a jury trial in a California federal courtroom. The proceedings are anticipated to feature testimony from prominent figures in the AI sector, including Microsoft CEO Satya Nadella, Microsoft CTO Kevin Scott, and Mira Murati, formerly OpenAI's CTO and now founder of Thinking Machines Lab.

At the core of the lawsuit are allegations that OpenAI has deviated from its foundational mission to develop Artificial General Intelligence (AGI) for the benefit of all humanity. Furthermore, the suit includes claims of potential fraud, unjust enrichment, and a breach of OpenAI's charitable trust. Mr. Musk is petitioning the court to "strip Sam Altman and Greg Brockman of their positions of authority and the personal financial benefits they extracted from OpenAI’s illicit for-profit operations and conversion," alongside demands to reverse OpenAI’s restructuring into a for-profit entity, among other remedies.
