Elon Musk's artificial intelligence venture, xAI, is facing a federal lawsuit in California, with three anonymous plaintiffs alleging that the company should be held accountable for its AI models generating abusive sexual images of identifiable minors. The complaint, filed Monday, asserts that xAI's technology facilitated the creation of such illicit content.

The plaintiffs aim to expand this into a class-action lawsuit, representing any individual whose real images from their minor years were transformed into sexual content by xAI's Grok model. They contend that xAI failed to implement fundamental safeguards widely adopted by other leading AI laboratories to prevent their image generation models from producing pornography depicting actual individuals, especially minors. The case, titled JANE DOE 1, JANE DOE 2, a minor, and JANE DOE 3, a minor versus X.AICorp and X.AILLC, was lodged in the U.S. District Court of California Northern District.

The lawsuit specifically highlights that most deep-learning image generators utilize various techniques to prevent the creation of child pornography from ordinary photographs. It alleges that xAI neglected to incorporate these crucial industry standards into its own models.

A key technical argument presented is that if an AI model is designed to generate nude or erotic content from real images, it becomes virtually impossible to prevent it from subsequently generating sexual content featuring children. The legal filing places significant emphasis on Elon Musk's public endorsements of Grok's capacity to produce sexual imagery and depict real individuals in revealing attire.

xAI did not provide a response to TechCrunch's request for comment regarding the allegations.

One of the plaintiffs, identified as Jane Doe 1, discovered that pictures from her high school homecoming and yearbook had been altered by Grok to depict her unclothed. She was alerted by an anonymous tipster via Instagram, who informed her that these images were circulating online and provided a link to a Discord server featuring sexualized images of her and other minors she recognized from school.

In another instance, Jane Doe 2 was contacted by criminal investigators who had found altered, sexualized images of her created by a third-party mobile application that leverages Grok models. Similarly, Jane Doe 3 was notified by criminal investigators who uncovered an altered, pornographic image of her on the phone of an apprehended subject. Attorneys for the plaintiffs argue that despite third-party involvement, xAI bears responsibility because the usage still relies on the company's underlying code and servers.

All three plaintiffs, two of whom are still minors, are reportedly experiencing extreme distress due to the circulation of these images and the potential repercussions for their reputations and social lives. They are seeking civil penalties under various laws designed to protect exploited children and address corporate negligence.
