AI Challenges at the U.S. Copyright Office: A Shift in Authorship

In 2024, the U.S. Copyright Office faces significant challenges as generative artificial intelligence technology continues to evolve. This technology has sparked debates on the definition of human authorship in copyright law, which is traditionally based on works created solely by humans. 

While the U.S. Constitution grants copyright protection to human-created works, generative AI has blurred the lines. The Copyright Office has upheld the principle that only human creators can claim authorship, rejecting multiple AI-generated works despite human involvement in the creation process. 

AI-Generated Works and Copyright Challenges

In 2023, the Office clarified its stance, stating that works created by AI, even with human input, do not qualify for copyright protection. For example, the 2023 rejection of the graphic comic “Zarya of the Dawn” and the word “Théâtre D’opéra Spatial,” which used the AI platform Midjourney, highlighted this policy. 

Creators of these works argued that their role was akin to that of a film director guiding a cameraman, but the Office maintained that true authorship requires human creativity.

Another notable rejection occurred in December 2023 when the Copyright Office denied registration for a work titled “SURYAST,” created with the RAGHAV AI system, stating that the applicant lacked sufficient creative control. 

The Office’s decisions are part of a broader trend where AI-generated visual art faces rejection due to insufficient human contribution. This has led to legal challenges, such as Jason Allen’s lawsuit in 2024, which argues that his creative direction using AI tools should qualify for copyright protection.

These ongoing issues have prompted the Copyright Office to study the evolving role of AI in creative processes.
