Elon Musk Files Injunction to Halt OpenAI’s For-Profit Transition

Elon Musk has taken legal action against OpenAI, Microsoft, and several key figures, accusing them of engaging in anticompetitive behavior. Musk’s legal team is seeking a preliminary injunction to halt what they describe as a shift away from OpenAI’s original mission, potentially harming competition and Musk’s AI company, xAI.

The injunction, filed in the U.S. District Court for the Northern District of California, names OpenAI’s CEO Sam Altman, President Greg Brockman, Reid Hoffman, and Dee Templeton. It alleges that OpenAI and Microsoft pressured investors not to fund rival companies like xAI.

Musk’s attorneys claim that OpenAI has benefited from “wrongfully obtained” sensitive information through its partnership with Microsoft. They also accuse OpenAI’s leadership of self-dealing, citing the selection of Stripe as a payment processor, where Altman holds a significant financial stake.

The filing argues that OpenAI’s transition from a nonprofit to a for-profit entity has betrayed its original mission to serve the public interest. Musk, a co-founder of OpenAI, left in 2018 due to disagreements over its direction and claims he was defrauded of $44 million in donations.

Despite these challenges, xAI recently raised $5 billion, positioning it as one of the best-funded AI startups. However, Musk’s legal team insists that OpenAI’s actions are limiting xAI’s growth by discouraging potential investors.

Microsoft, OpenAI’s largest investor with a $13 billion stake, is also under scrutiny. Musk’s attorneys allege that Microsoft facilitated deals that undermine competition while giving OpenAI privileged access to cloud resources critical for AI development.

The legal filing warns that without immediate intervention, OpenAI may not have enough funds to pay damages if Musk’s claims are upheld. It calls for a pause in OpenAI’s for-profit transition to protect the organization’s founding mission and prevent further harm.

OpenAI, however, dismissed the lawsuit as Musk’s “fourth attempt” to challenge their operations, labeling the claims as baseless and without merit.
