Elon Musk’s social media platform, X, is refusing to comply with a criminal investigation by French prosecutors, calling the probe politically motivated and a danger to free speech. The investigation involves allegations of algorithmic bias and unlawful data collection. French authorities recently intensified the case, authorizing surveillance measures and potentially summoning Musk or senior executives for questioning. X, however, denies all claims and has declared it will not comply.
In a public statement, X accused French authorities of misusing legal tools to suppress digital expression. The platform posted that the investigation distorts French law to serve a political agenda, potentially infringing on open discourse online. Prosecutors have not officially responded, though French law does permit fines or obstruction charges for non-compliance.
The investigation reportedly stems from a complaint by French MP Éric Bothorel, who accused X of foreign algorithmic interference. The platform called these claims “completely false,” while Bothorel defended the legal process and emphasized the importance of accountability in protecting free speech.
Researchers David Chavalarias and Maziyar Panahi were also drawn into the case, as authorities requested data from X for analysis. X objected, citing bias from the researchers. Panahi denied involvement and criticized the mention of his name, warning it could lead to legal action due to reputational harm.
One major concern from X is the legal strategy used by French prosecutors, who invoked organized crime laws to authorize actions such as employee wiretaps—an uncommon approach in technology-related cases. X argues these measures are excessive and disproportionate.
This conflict highlights growing tensions between U.S.-based tech companies and European governments over platform accountability, data practices, and content moderation. The European Commission has already been investigating X under the Digital Services Act for failing to curb harmful content, adding pressure on the platform amid rising regulatory scrutiny across the continent.
